Residential parental relocation

An example of a divisive issue is non-consensual residential parental relocation. The current law supports “a mother’s right to live whereever she pleases” (D and SV [2003] FamCA 280 - CORAM: NICHOLSON CJ, KAY & MONTEITH JJ). This judgement has been criticised by fathers' groups since (a) there is no requirement to provide a reason for relocating with the children, or (b) to inform the non-resident parent (usually father) of the intended move.
