The Alien Registration Act or Smith Act (18 USC 2385) of 1940 made it illegal for anyone in the United States to advocate overthrowing the government. It also required all non-citizen adult residents to register. Although initially targeting supporters of the Nazi regime, the first prosecution under the Smith Act was directed against the Trotskyist leaders of the Socialist Workers Party (US) in 1941. It was also used extensively in prosecuting members of the U.S. Communist Party.1 See also
